Terms & Conditions

Effective date: October 29, 2026

Read the Refund & Cancellation Policy

These Terms and Conditions apply to real estate media services provided by Tristen Madron, a sole proprietor doing business as Madron Media (“we,” “us,” or “our”). By accepting these terms when booking, you agree to the following conditions including the cancellation and refund rules below.

1. Services and booking

We provide real estate photography, drone photography, property videos, floor plans, 3D tours, and related services. Your booking confirmation or written proposal identifies the services, price, appointment details, and any agreed delivery schedule.

A shoot is reserved only once your payment card is successfully saved and your booking is confirmed. An unpaid request does not reserve the date or time. Additional services or changes that affect the price require your approval before they are charged.

2. Payment authorization

A valid payment card is required to book. No service payment is collected at booking; your card is saved through our payment processor. Your bank may display a temporary verification authorization.

By accepting the payment authorization at checkout, you authorize us to charge the confirmed booking total at 8:00 AM Pacific Time on the scheduled shoot date, and any applicable cancellation fee described below.

Cancellation and changes: Submit a cancellation or change request using your order code on the Cancel/edit shoot page. Requests are reviewed by Tristen Madron and take effect only after approval. Date, time, package, and add-on changes require approval; any revised price will be agreed before additional charges.

Cancel by 5:00 PM Pacific Time one business day before your shoot for no cancellation charge and a full refund of canceled services. Business days are Monday through Friday, excluding observed U.S. federal holidays. After that deadline, cancellations and missed appointments carry a 35% fee, which Tristen Madron may waive. Late rescheduling cancels the original appointment at a 35% fee, with the replacement appointment billed separately. No upfront service payment, short-notice fee, or flat late-change fee applies. The Refund and Cancellation Policy contains the complete rules.

Cancellation fees replace, rather than add to, the price of canceled services. Approved additional services are billed separately. If a payment fails, we will contact you and may postpone the appointment or withhold delivery until payment is resolved.

3. Property access and preparation

You are responsible for obtaining permission from the owner and any occupants for us to enter the property, perform the booked services, and create media for the authorized marketing purposes.

The property must be accessible, safe, and ready at the appointment time. Please complete cleaning and staging, secure pets, notify occupants, and remove or conceal valuables, personal documents, and items you do not want photographed.

Tell us about known hazards or access restrictions before the appointment. We may decline or stop work if conditions are unsafe or access is unauthorized. Client-caused access failures or readiness issues that prevent the shoot are reviewed under the cancellation rules in Section 2; any applicable fee may be waived by Tristen Madron.

4. Weather, drone operations, and circumstances outside our control

Drone services depend on weather, airspace restrictions, necessary authorizations, and safe operating conditions. Specific aerial views or flights are not guaranteed.

If weather, safety restrictions, illness, equipment failure, or another circumstance prevents us from completing a service, we will offer an appropriate rescheduling option or refund for the unperformed portion. No client cancellation fee applies when we cancel or require rescheduling for these reasons.

5. Editing, delivery, and service concerns

Our services include editing consistent with our portfolio and the agreed scope. Unless specifically included, raw files, unedited footage, project files, substantial object removal, virtual staging, and additional revisions are not included.

Any agreed delivery schedule will be confirmed in writing. Final media is delivered through a Dropbox folder link provided in your shoot details and delivery email; client photos and 360 tours are not hosted for viewing on this website. We will notify you of material delays. Third-party tour hosting periods and any renewal charges will be disclosed before purchase.

If delivered media contains a technical defect or does not match the agreed scope, contact us promptly so we can assess the issue and offer a correction, reshoot, or appropriate refund based on the uncorrected or unperformed portion of the agreed services.

Download and back up delivered files promptly. Permanent file storage is not included unless agreed in writing.

6. Copyright ownership

We retain copyright in the original photographs, videos, and other copyrightable materials we create, except where a separate written agreement signed by us expressly states otherwise. Purchasing our services or receiving files does not transfer copyright, and our work is not offered as work made for hire.

Third-party music, software, hosting, and other licensed materials remain subject to their respective owners’ rights and applicable license restrictions.

7. Your license to use the media

Once full payment is received, we grant the booking client a nonexclusive license to use the final delivered media to market the photographed property and promote the client’s own real estate services. Permitted uses include listing websites, MLS listings, social media, printed marketing, and the client’s website and portfolio.

You may provide the media to your brokerage, MLS, listing platforms, and marketing vendors as reasonably necessary for these permitted uses, including ordinary listing syndication and archival display. This permission does not transfer copyright or authorize unrelated reuse.

Selling, sublicensing, transferring the media to another agent for a new listing, or allowing builders, designers, rental operators, or other businesses to use it for their own marketing requires our prior written permission. If a platform requires rights beyond this license, contact us before uploading.

8. Alterations and attribution

Routine resizing, file compression, and minor cropping for layout are permitted when they do not materially change the appearance or meaning of the media.

Filters, recoloring, AI edits, virtual staging, object removal, substantial retouching, or other material alterations require our prior written permission. Do not remove an existing watermark or credit without permission, or represent an altered version as our original work or as approved by us.

Contact us if you need a modified version for a particular use.

9. Accurate property marketing

You are responsible for checking listing information and complying with applicable advertising, brokerage, MLS, and platform requirements.

Floor plans and measurements are approximate marketing aids, not surveys, appraisals, or architectural drawings. Verify dimensions and property details independently before relying on them.

Virtual staging and other material digital alterations must be disclosed wherever required. Our services do not guarantee a sale, sale price, buyer response, or listing performance.

10. Our portfolio use

We will obtain separate written permission before using identifiable property media in our own portfolio, advertising, or social media. Permission must come from the property owner or someone authorized to grant it. Access instructions, gate codes, and lockbox codes will never be included in published media.

11. Privacy and property security

We collect information you provide to request or receive services, including your name, email address, phone number, billing information, property address, and access instructions.

We use this information to manage bookings, communicate about services, process payments, access properties as authorized, deliver media, maintain business records, and resolve service issues.

We do not sell or rent your personal information, or share it with third parties for their own marketing. We disclose information only as reasonably necessary to service providers supporting our business, authorized personnel completing your booking, or when required by law or reasonably necessary to address fraud or security issues.

Gate codes, lockbox codes, and other access instructions are treated as confidential. Access is limited to authorized people and systems that need them to complete the booking. Property notes and change-request messages are deleted from active booking records when a shoot is marked delivered. Copies may remain in notification emails or routine backups until those copies are deleted or expire. Read our Privacy Policy for retention details and removal requests.

Payments are handled by Stripe. On recognized devices, this website may remember previously entered contact details to offer suggestions during future bookings. Optional account sign-in can help you access your shoot details across devices. Contact suggestions are stored on your device; clearing your browser’s site data removes them from that device.

Payments are handled by our payment processor. We do not store full payment card numbers or card security codes in our own booking records.

We use reasonable safeguards to protect information, but no electronic system can guarantee absolute security. We retain personal information only as reasonably necessary for services, business records, legal obligations, and dispute resolution.

Use the website contact page to ask about your information or request access, correction, or deletion. We will respond as required by applicable law; some records may need to be retained.

12. Responsibility and limitations

Each party remains responsible for its own acts and omissions. To the extent permitted by law, our total liability for claims relating to a particular booking is limited to the fees paid or payable for that booking, and we are not responsible for indirect or consequential losses, such as lost sales or anticipated profits.

These limitations do not apply to fraud, intentional misconduct, gross negligence, bodily injury, damage to tangible property, or any liability or rights that applicable law does not allow us to exclude or limit.

13. Governing law and updates

Oregon law governs these terms, subject to any mandatory laws that apply. Please contact us first about a concern so we have an opportunity to resolve it. This request does not restrict your legal rights or remedies.

Changes to these terms apply to future bookings. Existing bookings remain subject to the version accepted when booked unless both parties agree otherwise in writing.
